Question For Shorethings

I needed some breakwater repair (Docking Structure Repair) work done on my island home after last years ice out. I hired a local company last August to do the work and they applied for and were given all the permits on my behalf.

The work was supposed to be completed by the end of October. Unfortunately the company I hired has been completely unresponsive and after finally contacting them today I was told they have no intention of completing the work till next year.

Needless to say I am rather upset and would like to find a more reputable and reliable company to do the work.

My question is...is my current permit good if another company performs the work or do I have to submit and go through the entire process all over again? I am hoping to avoid this after paying an $800.00 permit fee.

Shorethings can verify, but I believe the permit goes with the property, not with the person or company who submitted the application. I wouldn't be surprised if you needed to sign something that allowed them to act on your behalf as the property owner. So you should be able to hire another company using the same approved permits, though you should check on how long the permits are good for before expiring.

The permits are public record and you can probably find yours on their website. It may give you all the information you need to answer your questions and talk to another company.

The permit is issued to you as the owner, not to any specific contractor. You can hire whomever you wish. Good luck.

btw... If for some reason you don't have the paperwork (ie. your contractor filed a Permit by Notification and failed to give you a copy) contact our office and we will get copies to you.

While you may be correct, section 8 of the permit note the "Authorized Agent" who is the original company hired. That is why I have a concern.\

It just really stinks to be put in this situation as my breakwater got beat up so badly last year another bad ice out like last year and my entire dock is toast. If the company would of just been upfront with me to begin with instead of using me as "backlog" I would of had the opportunity to hire someone else to do the work before further damage occurs over the winter.

If I remember correctly, the permit is issued to the person who pulled and signed for it. That is why it is best the homeowner signs the paperwork. The contractor can do all the leg work and bring papers back for homeowner to sign. Doing it that way you can change the contractor name on your permit and resubmit with out all the hassle. Again I'm not sure, but when doing renovations on my house I ran into the same problem and I did what I mentioned above.

I might suggest that its not such a terrible idea to wait until the spring to do the work anyway. One less winter to for the ice beat up the newly refurbished breakwater. It would be a shame to spend the money on the repair now just to have it crushed again this spring before you ever got the benefit of it.

The problem is last winter the ice tumbled over some very large rocks. There is no way now the the breakwater will work as designed and allow the ice to slide over the rocks and breakup off the back as its supposed to. The rocks now, if pushed by the ice, will destroy my dock. They were aware of this when a proposal was given and I accepted it. I was assured time and time again not to worry and they would be out there and that the work would be done at the end of October. Even at the beginning of November I contacted them again and was assured they were still coming. They never once tried to contact me by phone or email in the past 4 weeks to tell me they were never planning on coming out until I finally called them this morning. Now I am stuck and can only hope my entire dock system does not get destroyed as I have no place else to turn at this point. They really have put me in a terrible situation and the worse part is they don't care...
