It appears that Brewster Academy violated the FAA rules for commercial use which "The agency bars commercial use of drones no matter how seemingly benign". Here's a story about the FAA coming down on a baseball team for basically doing exactly what Brewster Academy did which was film some video from a drone to promote their business. Here's the article:

I have a GoPro camera and have ordered a pocket drone. Since I want to create some videos for this site is it commercial use and prohibited? The rules seem to be very muddy right now.
