About five years ago, the State of New Hampshire completed a major straightening and rebuilding of a two mile stretch of Route 3 in Holderness, as it passes past Little Squam Lake. Included with the road construction, the state also built a very well constructed sidewalk, about one mile long by five feet wide, constructed with asphalt and granite curbs as well as some large, expensive, well-made, natural granite stone retainer walls.
Driving past it in the winter, I've noticed that it does not have the snow removed, and in some spots gets road snow piled onto it by the passing snow plows.
So, why do I bring this up? In today's June 12
www.citizen.com, there's a story about the Town of Tilton recently losing a law suit titled "Town loses ADA case" where Tilton was sued for not removing snow from a sidewalk. The plaintiff gets around in a battery powered electric scooter and he was miffed that he had to use the highly trafficked Route 140, where it passes over Route 93 on a bridge, as the sidewalk was snow covered, so he sued with the help of the Disabilities Rights Center in Concord. The NH Supreme Court just ruled that Tilton must perform winter maintenance.
Do you think this ruling will encourage Holderness to do winter maintenance on their very nice sidewalk?
Not that it's any of my business, but if you google 'Bombardier sidewalk snowplow snowblower craigslist' there are some for sale at prices which will make a local selectman smile.........
