Default Texting While Driving in NH

I'm not a cell phone owner so have no knowledge of the particulars of texting. Someone said it's against the law to "Text" while driving in NH. So if a LEO stops someone for "Texting".....How does the LEO determine that texting was actually occurring?

Does the LEO have to confiscate the phone on the spot, as evidence of the crime? Couldn't the perpetrator just DELETE the screen ..or message....when he saw the blue lights? Inquiring minds.. NB
