Adding sand behind existing retaining wall at shoreline?

I have a retaining wall at the shoreline, currently there is crushed stone, do I need a permit to replace with sand to make a sandy area?

It looks kinda funny in this photo but it's longer then it looks to its easy in and out. Also if it was the other way you would have to stare at the wall. This was towards the end of construction....

We just remodeled our master bath, we used Raleigh homes. They did an incredible job! I wish I had a picture of before because it was very 70's with honeycomb tiles!
